Litigation Support

What is litigation support?

In the event an organisation or individual wishes to pursue an investigation in a criminal, civil or industrial tribunal, evidence must be collected and collated by experts familiar with the process. This back-office work is called litigation support.

Expert witness testimony in court is also included in litigation support services.

When might litigation support be required?

Litigation support includes the collection of evidence on any suspected illegal activity - from insurance fraud to proceeds of crime investigations to securities manipulation. The range of issues is limitless. What's important is that evidence is correctly collected and presented.

For example, at GSS our investigators are trained to provide tape-recorded interviews to Police and Criminal Evidence (PACE) standards for use in criminal, civil or industrial tribunal proceedings. As well, we are regularly called to act as expert witnesses in court.

What will typical litigation support services include?

  • Help in collecting documentation to support or refute a claim.
  • An expert review of relevant documentation in order to assess the case and identify areas of loss.
  • Assistance with Examination for Discovery, including assistance in drawing up questions to help collate financial evidence.
  • Attendance at Examination for Discovery proceedings to review the testimony, and advice on any issues that might crop up.
  • A review of the opposing expert's damages report, with an analysis of its strengths and weaknesses.
  • Attendance at trial to hear the testimony of the opposing expert.
  • Advice on cross-examination tactics for individuals on trial.
